Veterans
Affairs Canada (VAC) uses the complex process shown above. The process
starts when you submit your disability claim. VAC will then
send you forms for your doctor to complete. A critical
element to success is to clearly show how your condition is
connected to your Service.
Once your doctor returns the
forms you file will make it's way to a VAC Disability
Adjudicator who will determine whether or not you are
entitled to receive Pain and Suffering compensation. If your
claim is denied you have the right to ask the Bureau of
Pensions Advocates (BPA) to prepare your file for a Review
Hearing by the Veterans Review and Appeal Board (VRAB). You
will be assigned a lawyer who will prepare your case and
represent you at the Hearing. You will attend the Hearing
either in person or via Phone or Video Conference. You
may be asked questions by the Panel members but your lawyer
will do most of the talking.
If your claim is denied by
VRAB you can ask BPA to take your file to Appeal before VRAB.
An Appeal is done by written submissions which your lawyer
will prepare and submit to the VRAB Panel for consideration. |
